Tulsa, United States - January 11, 2019 /PressCable/ —
In many cases, extreme crashes cause extreme injuries. Fully loaded semi-trucks weigh over 80,000 pounds, the same weight as a 3 bedroom, 2 bath house. They also carry hundreds of gallons of highly-flammable diesel fuel. On the other end of the spectrum, people in cars, pedestrians, and those on bikes and motorcycles have little or no protection from onrushing vehicles. The combination often leads to catastrophic injuries.
According to Oklahoma News 4, Multiple agencies responded to a multi-vehicle wreck the Turner Turnpike near Luther around 7 p.m. on Thursday. The initial report came in as at least 20 vehicles involved in a wreck on the turnpike, but authorities have since confirmed four vehicles and one semi-truck are involved. The accident occurred in the eastbound lanes between Luther and Wellston and narrowed the highway to one lane.
The assertive lawyers at Dodd Henry stand up for accident victims in all of these situations. During our years of experience, we have developed proven methods which have delivered maximum compensation to thousands of victims. Our lawyers are relentless, both during pretrial settlement negotiations and during trial. In many cases, the results speak for themselves.
Types of Catastrophic Injuries in Oklahoma
Wrongful death is usually the most tragic type of catastrophic injury. Procedurally, these cases are different from other types of negligence cases. Under Oklahoma law, most survivors are entitled to pecuniary losses. This broad term includes a wide array of losses. Additionally, some survivors may be eligible for additional compensation pursuant to the negligent infliction of emotional distress doctrine.
Other types of catastrophic injuries are survivable, but result in long-term financial and emotional losses. These injuries include:
Head Injuries: Sudden loud noises, trauma wounds, and/or violent motion usually cause head injuries. All brain wounds, including things like Post Traumatic Stress Disorder, are always physical injuries. Moreover, these injuries are always permanent. However, a combination of surgery and physical therapy often significantly eases the symptoms.
Burns: These wounds are particularly common in truck crash cases. Diesel fuel burns at a different temperature from gasoline. So, crash victims often sustain third or fourth-degree burns. These injuries always require painful skin grafts and months of recuperation.
Internal Bleeding: Kidneys, livers, and other internal organs have no skin cells for protection. So, when they grind and bump against each other, they often bleed profusely. Many times, first responders and doctors do not stop this bleeding straightaway. This may lead to a victim losing vital fluid for hours.
Damages in these injury cases usually include compensation for economic losses, such as medical bills, and non-economic losses, such as pain and suffering. Additional punitive damages may be available as well, in some cases.
Oklahoma Law and Pre-Existing Conditions
Many people have adverse medical histories or genetic backgrounds that make them more susceptible to additional illnesses or injuries. Often young victims and elderly victims are more vulnerable to injury than others. Insurance company lawyers quickly point out that the tortfeasor (negligent driver) only directly caused some of the new injuries.
Just like the tortfeasor may not necessarily “cause” all the victim’s injuries, the tortfeasor may also not be the only person legally responsible for damages. Oklahoma has a number of vicarious liability rules, such as alcohol provider and employer liability.
These doctrines are especially important in catastrophic injury situations. Many times, individual tortfeasors do not have enough insurance coverage to provide full compensation. Third party liability gives these victims an additional source of recovery.
