When asked to comment, Dominy said that there are several moving parts to a DUI charge, which - with the right representation - might not always lead to a conviction.

According to Dominy, most people have misconceptions about being singled out for DUIs by law enforcement.

"Many think the only people who get pulled over for drunk driving are those who are driving erratically all over the road. The reality is most of the cases I see don't involve that kind of bad driving," he said.

In other words, he added, a broken headlight or taillight that would typically result in routine stops could lead to a DUI charge.

By the time that clients seek Dominy’s guidance, they assume that they will be found guilty of a DUI charge no matter what.

"Many people feel that way because a police officer trained in DUI investigations has determined that they were under the influence, and so they feel like they can’t fight it,” he added.

However, he said, there are several things that he as a defense attorney can do to lessen or dismiss the charge, particularly as law enforcement and jury members have differing standards in DUI cases.

When asked to elaborate, Dominy said, "To make an arrest, officers only need to have probable cause to believe a person is under the influence. To be found guilty by a jury, a jury has to conclude that the evidence proves guilt beyond a reasonable double, which is a much higher standard."

One of the first things Dominy looks at when a client walks through the door is how a driver’s license has been suspended.

"There are certain methods that the police officers have to use when imposing a license suspension. They have to follow a certain protocol. If the officers don’t follow certain protocol and it can be proven, the license could be returned to the client,” Dominy said.

However, he continued, getting a license back doesn't mean a dismissal of a DUI charge. The next step in the process is contesting the admissibility of evidence, such as the chemical and field sobriety tests.

“If the tests aren’t administered in compliance with how the National Highway Traffic Safety Administration has told officers how tests are supposed to be administered, the tests may be thrown out altogether,” he said.

According to Dominy, his law firm prepares a case as if it will go to trial, even though the prosecution might offer a plea bargain.

When asked to explain further, he said, "Sometimes the prosecutor will recognize that they have some weaknesses in their case, so they offer to reduce their charge to something lesser." At this point, he said, the client decides whether or not to accept the plea bargain offer or to go to trial.

A key takeaway from Dominy’s interview is the importance of making informed decisions. People charged with DUI, he says, should do thorough research before deciding: if they will plead guilty or not guilty, whether they will hire a lawyer, and which attorney to hire.
